Wendy, even after nearly 40 years working in court, the last nearly 20 in federal court in an extremely busy border district, I have never heard (or read) a more succinct and understandable-to-a-nonlawyer explanation of the history and implementation of habeas corpus. Thank you, thank you, thank you. The way most habeas motions came before our court (federal) were not in the immigration context but on a motion from an appeal of a state supreme court denial in a death penalty case. It was rarely, if ever, at least in an argued motion, used in immigration cases. Again, thank you for this. It's a keeper.
"Blatantly Unconstitutional" is right. Good points. Nosferatu McGobbels Miller is an enemy of freedom and basically a goddamned asshole. Can't wait 'til these fuckers have been held accountable - and it won't be pretty. Frightening.
Thank you for making this clear for all. Don't know how you managed to maintain your equilibrium to get it all down! To me, (having a criminal justice degree) Habeas Corpus is everything. When I first saw a clip of Miller on Fox gleefully put forth this notion, my jaw dropped open, and stuck there. I can't even describe or explain the many extreme emotions that began exploding in my head. I remember reading Justice Kennedy's opinion on Boumediene v Bush, from 2008. I literally just can't even.
This is something I really fear he will attempt. He’s already been kicking around the idea of martial law. My other fear is the GOP majorities in congress seem to go along with anything and everything he desires. There will come a time for a reckoning. Hopefully sooner than later.
Pee 2025 specifically calls for these steps that we've witnessed on the way to martial law, then suspending the constitution, then no voting..... and it's all going according to the plan.
